Perspective – The liability conundrum: who bears risk for rogue software and AI systems?

When software or AI systems malfunction, the question is no longer whether anyone is accountable, but who. AI developers as well as deployers may be held liable. This address will seek to unpack how responsibility is shared across the digital supply chain - from manufacturers and importers to platforms and deployers - and confront the emerging notion of "agentic liability", asking who answers for the autonomous decisions of AI agents acting within, or beyond, their instructions.  It will also map out the regulations to watch out for in the near future, and suggest how to bolt in contractual safeguards.
