The European Commission has recently published a proposed directive for the protection of undisclosed know-how and business information (trade secrets) (the “Directive”) which can be accessed on this link. The Directive is intended to harmonise the national laws of the EU Member States in this regard by providing a definition for trade secrets; it also provides for the calculation of damages, the preservation of trade secrets during legal proceedings, and remedies available for unlawful acquisition.

The Directive is especially important for employers operating in various jurisdictions who seek to protect their trade secrets against unlawful misappropriation.
